Tax deed sales in Florida: research before you bid

Tax deed auctions can look like bargains. The properties that become problems are usually the ones nobody researched before the auction.

When property taxes go unpaid long enough, Florida counties can auction the property through a tax deed sale, run by the clerk of court. Bidders often get little information beyond the parcel number and a minimum bid.

What to research first

  • Title and liens: some liens and obligations can survive a tax deed sale. An attorney or title company can tell you which ones apply.
  • Code enforcement: open violations and fines recorded against the property.
  • Open permits: unfinished work that may need to be closed out.
  • Occupancy: whether someone lives there, which affects how and when you can take possession.
  • Physical condition and access: what is actually on the lot, and whether it has legal road access.
  • Zoning and use: what you are allowed to do with it.

Where the records live

The clerk's official records, the property appraiser, the tax collector, the building department and code enforcement. Each holds a different piece, and most are searchable online.

Title after the sale

A tax deed does not always give a title that a title insurer will insure right away. Ask an attorney or title company what it will take before you bid.
