Returning a security deposit in Florida: dates, deductions and notice

Deposit disputes are among the most common landlord-tenant problems. Florida law sets short deadlines and a specific notice, and missing them can cost the owner the right to keep anything.

In Florida, the security deposit rules are in section 83.49 of the Florida Statutes. They are short and strict, and they apply to the owner whether a manager handles the unit or not.

The deadlines

  • No deductions: return the full deposit within 15 days after the tenant moves out.
  • Deductions: within 30 days after move-out, send the tenant written notice of the intent to impose a claim on the deposit, by certified mail to the last known mailing address, with the reason.
  • The tenant's answer: the tenant then has 15 days to object in writing.

An owner who does not send the notice within 30 days can lose the right to make a claim on the deposit.

What can be deducted

Unpaid rent and damage beyond normal wear and tear, as the lease and the law allow. Faded paint and worn carpet from ordinary living are usually wear and tear; holes, stains and broken fixtures usually are not.

Keep the proof

Move-in and move-out photos, dated inspection notes, repair invoices and the certified mail receipt make any deduction easier to support.

Our security deposit return calculator totals the deductions and shows the notice deadline.
