Getting ready for a hearing: the support checklist

Most hearings are short, and the judge has little time. Having the notice, filings, exhibits and proposed order in order before the day helps counsel make every minute count.

Motion hearings are often set for 5, 15 or 30 minutes. Counsel argues; support staff make sure nothing is missing when the hearing starts.

A week or more ahead

  • Confirm the notice of hearing was served on every party.
  • Read the judge's division instructions: many require courtesy copies, binders or a proposed order sent ahead.
  • Gather the motion, the response and every case or exhibit counsel will cite.

A day or two ahead

  • Prepare a proposed order if the judge wants one, in the format the division asks for.
  • For remote hearings, test the video link and send it to counsel and the client if they attend.
  • Tell the client the time and whether they need to be there.

After the hearing

Note the ruling, get the signed order, calendar any new deadlines and update the client, as counsel directs.
